1. General Conditions
1.1. Acceptance of Terms: By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms and Conditions. 1.2. Eligibility: You must be at least the age of majority in your state or province of residence, or possess legal parental or guardian consent, and be fully able and competent to enter into these Terms. 1.3. Modifications: We reserve the right to update, change, or replace any part of these Terms by posting updates on our website. It is your responsibility to check this page periodically for changes.
2. Products and Pricing
2.1. Product Types: PetalPins sells two primary types of products: Ready-Made Items (from our existing collections) and Custom & Personalized Items (made to order using a pin press or other custom manufacturing). 2.2. Pricing: Prices for our products are subject to change without notice. We are not liable to you or to any third party for any price changes. 2.3. Color Accuracy: We have made every effort to display the colors and images of our products as accurately as possible. We cannot guarantee that your device's display of any color will be accurate. 2.4. Sales Tax: Applicable sales tax will be added to the purchase price as required by local, state, or federal laws.
3. Custom Order and Design Submission
3.1. Artwork Approval (Proofs): For all custom orders, PetalPins will provide the customer with a digital proof of the final design. Production will only begin after the customer has formally approved this proof in writing (via email). 3.2. Customer Responsibility: The customer is solely responsible for verifying all elements within the digital proof, including spelling, colors (using provided pantones or hex codes), positioning, and quantity. 3.3. Liability for Errors: Once the digital proof is approved, PetalPins is not responsible for errors in the final product that were present in the approved proof. Custom orders are subject to the Refund Policy (Section 2.A). 3.4. Production Time: Quoted production and delivery timelines are estimates. We are not liable for delays caused by shipping carriers, customs, or manufacturing issues outside of our direct control.
4. Intellectual Property and Licensing
4.1. Customer-Submitted Content: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize PetalPins to use all intellectual property (IP), including logos, images, and trademarks, contained in the artwork you submit for custom orders. 4.2. Indemnification: You agree to indemnify and hold PetalPins harmless from any and all claims, damages, and expenses (including legal fees) arising from any actual or alleged infringement of a third party's IP rights related to the custom designs you submit. 4.3. PetalPins Content: All original content, text, graphics, logos, images, product photos, and the compilation thereof on the PetalPins website are the property of PetalPins and protected by copyright and IP laws.
5. Termination
5.1. We may terminate your access to our website or cancel orders without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. 5.2. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
6. Governing Law
6.1. These Terms shall be governed by and construed in accordance with the laws of [Insert Your State/Province Here], without regard to its conflict of law provisions.
